For the past few days (and even now), the headline of major news papers focused on Ted Failon and the mishap that happened to his wife and family. As a personality, Ted Failon’s case has catapulted to lime light and was followed by almost everyone. Even those who are not a fan of Mr. Failon.
But what caught my attention (as well as of some friends) is the the conduct of the QCPD/PNP in handling this issue. Many have already been vocal in saying that the way Mr. Fialon is being man-handled as well as his wife’s relative and family helpers is a form of political vindetta. A retaliation for his and ABS-CBN’s critical stance against PGMA?
Some of my friends expressed their weary on how this thing is going, seeing it by their own eyes on the television. How the police are arrogantly push and arrested people in the name of obstructing justice. What ever happened to the Miranda Principle? Of being innocent until proven guilty?
Similarly, What the heck is PD 1829? Watching the news last night and hearing policemen invoking this will just leave you dumb founded! What the hell is that? What just happened? Are the police allowed to warrantlessly arrest suspects? I knew of some cases when they can do. But why is warrantless arresst being done without clear reasons in this case?
A friend at Facebook was reminded of the PGMA’s Proclamation during the State of National Emergency fiasco in 2006 and Atty. Ted Te of FLAG was reminded of Marcos. In fact, PD 1829 was really a Marcos proclamation. And me, I was reminded that human rights should always be defended and staying silent on issues like this can be equated to condoning it.
I don’t know for the police, but if they’re gonna arrest someone, there should be an arrest warrant, unless it’s a continuing crime…
The police should clearly answer that…
We were watching how these supposedly “Police” who were supposed to “protect the people”, via TFC in California and my American friends can not believe at how people were mishandled and treated by these so-called “police.” They knew there were cameras and reporters all over the place and these did not prevent them from acting like wild goons ready to kill those innocent till proven guilty people. Can you imagine what these guys would do off camera? They should be blindfolded and beaten (hate to say this) not suspended. The arrested were in handcuffs, do they need to hold the guy in his collar nearly choking the poor guy. These actions show how some of our military and police are so insensible they make it harder for the good ones to fulfill their duties without repercussion and mistrust from the public!
I think you people must undergo also Jurisprudence in Law and must learn a little trick in Law in order to apply it whenever possible. It was proven before…and the law will be proven again this time.. just left it to the investigators, you may try your luck in court but i guess it might be futile because what has just been applied was according to the book and laws and procedures.. If you watched the video try asking also for the unspliced or unedited copy from ABS CBN. What happened before the arresting was made.. then you judge it again for yourself… i’ll bet if ABS CBN will give it you..gud luck
reminder: Obstruction of Justice for Mr Ted Failon for a clearer understanding:
1. According to investigation, up to now Mr Ted did not yet surrendered one of the most vital pieces of evidence and that is “the clothes that he wear to include also the clothes of her wife during the time of the death incident occured in their house… because maybe for some reason…
2.. Mr Ted did not surrender also the cellphones used to communicate with her wife to prove his innocence or his guilt.
3. Did not even want to give any phone number for him to be informed of whether he shall still be called upon for follow up investigation depending on the pieces to be found or discovered upon by the SOCO team.
4. He barred the family members also present during the time of the incident to give or shed light to the investigation proper even in the presence of their lawyers.

Nonetheless, people are reacting based on what they saw.
You can always argue that ABS-CBN is holding the whole story but other stations also aired almost the same video footage. So all the networks are ganging up on the QCPD? That’s quite interesting lens to look at.
You can’t also blame people to react since the QCPD has a record in mishandling incidents like the alleged Ortigas rub-out in which the CHR has been investigating and finally castigated.
You can also say that the arresting followed jurisprudence of the law but during the interview in GMA 7 which i was able to catch, the police admittedly stated that no warrant was served and needed for the “suspected” family member and helpers of Mrs. Failon. Seeing how they are being dragged is really appalling.
You can also invoke the PD 1829. But you can’t stop people to react. Until now, my reaction is still, what the hell is that? Resurrected proclamation during the Martial Law time!
As for the obstruction of justice, I personally agree that the law must be implemented. If they did obstructed justice then so be it. Pass judgment on people but don’t threat people that way. Follow due process and people will not react. Innocent until proven guilty!
